Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Nimdio cybersecurity awareness platform ("Service") operated by Nimdio ("we", "our", "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and have the authority to bind your organization to these Terms. By registering for an account, you represent that you meet these requirements.

2. Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized access
  • Organization administrators are responsible for managing user access within their organization

3. Acceptable Use

You agree to use the Service only for its intended purpose: cybersecurity awareness testing and training within your organization. You must not:

  • Use the Service to conduct unauthorized phishing attacks against individuals outside your organization
  • Attempt to access data belonging to other organizations
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service for any unlawful purpose
  • Share or redistribute simulation templates or threat intelligence data outside the platform

4. Phishing Simulations

Phishing simulations are designed to assess and improve your organization's security awareness. You acknowledge that:

  • Simulations will send emails, SMS, or voice calls to employees as configured by your administrators
  • All credential data submitted during simulations is discarded and never stored or used
  • You are responsible for obtaining any necessary internal approvals before running simulations
  • Nimdio is not liable for any disruption caused by simulations configured by your administrators

5. Subscription & Billing

Free tier includes up to 25 seats. Paid plans are billed according to the pricing displayed at the time of purchase. We reserve the right to change pricing with 30 days' notice.

6. Data Ownership

You retain ownership of all data you submit to the Service. We do not claim ownership of your organization's employee data, simulation results, or training records. See our Privacy Policy for details on how we handle your data.

7. Service Availability

We aim for 99.9% uptime but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable advance notice. We are not liable for downtime caused by factors outside our control.

8. Limitation of Liability

To the maximum extent permitted by law, Nimdio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

9. Termination

Either party may terminate the agreement at any time. Upon termination, your access to the Service will be revoked and your data will be retained for 30 days before deletion, unless you request immediate deletion.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Ghana, without regard to its conflict of law principles. Any disputes shall be resolved in the courts of Accra, Ghana.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will provide reasonable notice of material changes.
